1. Acceptance of Terms

By accessing or using the SafJob platform ("Platform"), you agree to be bound by these Terms of Use ("Terms"). If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use the Platform.

Your continued use of the Platform after any modification to these Terms constitutes acceptance of the updated Terms.

2. Description of Service

SafJob provides a construction safety observation platform including hazard logging, inspection management, incident reporting, worker sign-off capture, crew management, and AI-assisted corrective action recommendations ("Service"). The Platform is designed to support workplace safety workflows and OSHA recordkeeping processes.

The Platform is provided subject to change without notice. Features may be added, modified, or removed at any time during the pilot period.

3. Pilot Program Terms

During the Pilot Period, the Platform is provided at no charge under the terms of a separate Pilot Program Agreement executed between SafJob and the pilot partner. In the event of a conflict between these Terms and the Pilot Program Agreement, the Pilot Program Agreement controls.

The pilot period is pre-commercial. The Platform should not be relied upon as the sole means of OSHA compliance during the pilot period.

You retain ownership of all data you enter into SafJob ("Customer Data"). SafJob processes your Customer Data solely to deliver and improve the Service. We will not sell your Customer Data to third parties.

SafJob may use anonymized, aggregated data that does not identify you or your organization to improve the Platform, develop new features, and produce industry benchmarks.

8. Payment Terms

Following the pilot period, paid subscriptions are billed monthly in advance at the then-current list price. Pricing is per active site per month as published on the SafJob pricing page.

Pilot partners who convert to a paid subscription receive a 50% discount off the applicable tier list price, applied for the life of the account as long as the subscription remains active without interruption.

No refunds are issued for partial months. SafJob reserves the right to update pricing with 30 days notice.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SAFJOB DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF SECURITY VULNERABILITIES.

THE PLATFORM IS NOT A SUBSTITUTE FOR PROFESSIONAL SAFETY MANAGEMENT, LEGAL ADVICE, OR REGULATORY COMPLIANCE. AUTO-CLASSIFICATION OF OSHA RECORDABILITY IS A STARTING POINT — THE EMPLOYER IS RESPONSIBLE FOR FINAL DETERMINATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAFJOB'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO SAFJOB IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT WILL SAFJOB BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA LOSS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless SafJob LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; or (c) your violation of any applicable law or regulation.

12. Termination

Either party may terminate access to the Platform with 10 days written notice. Upon termination, your access will be suspended and your Customer Data will be held for 30 days pending export request. SafJob may terminate immediately for material breach of these Terms.

Upon your written request during the 30-day hold period, SafJob will provide a full export of your Customer Data in CSV format within 5 business days.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Platform will be resolved by binding arbitration in Seattle, Washington, under the Commercial Arbitration Rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

14. Changes to Terms

SafJob may update these Terms at any time. We will provide at least 30 days notice of material changes via email or in-app notification. Continued use of the Platform after the effective date of updated Terms constitutes acceptance. If you do not agree to the updated Terms, you may terminate your account before the effective date.
